E | Contracting Party’s Duties – British College Brazil

Make sure that all participants fulfil the medical sheet, authorization sheet and hotel authorization sheet and return the documents notarized to the responsible for the trip (documents will be available after payment)
• All participants must bear original documents (ID, RNE or Passport) for departure.

F | Contracted Party’s Duties – Chão Nosso Cultural Field Trips

• To provide all details about the itinerary as well as to make feasible all the services and activities outlined and required by the Contracting Party and featured in the Work Proposal.
• To inform the Contracting Party of adjustments and possible changes caused by acts of God.
• To supply the Medical Record and Trip Authorization forms as well any other authorization forms that may be required.
• To supply the arrangement of rooms and beds to accommodate the participants.
• To inform the School of all students who have actually boarded soon after the departure.
• To inform the School, at the departure time, about the final program and the telephone numbers of the place where the group will be throughout the event.

G | General conditions

• The services have been reserved.
• Chão Nosso Cultural Field trips states that it acts as a commission agent between passengers and suppliers (transport companies, hotels, restaurants, ships and other agent of rendering services) and cannot be hold responsible for any flaws or mistakes made by them. We also state that, in case of any inconvenience caused by flaws related to the suppliers hired by us, we will do everything in our power to ensure that the trip will be carried out within the best quality standards.
• Chão Nosso Cultural Field Trips reserve the right to change the itinerary and the program due to nature reason, acts of God or anything else that may put the passenger’s safety at risk.  Customers will be informed of the changes provided there is reasonable time.
• Prices are subject to change without a previous warning before closing the deal.

H | Cancellation and refund

Cancellation and refund fees are submitted to the specific conditions of suppliers or to
resolution act nº. 161 of August 9th, 1985, of EMBRATUR (as listed below):

  • • Refund of 80% for cancellations up to 31 days before the beginning of the trip.
    • Refund of 50% for cancellations between 21 and 30 days before the beginning of the trip.
    • Refund of 25% for cancellations between 07 and 20 days before the beginning of the trip.
    • No refund will be possible for cancellations made less than 07 days before the beginning of the trip.

Terms and Conditions Chão Nosso Cultural Trips

  • List of names and surnames with the ID or passport number (document with photo identification) of all participants (it must be the same document they will be carrying on the day of boarding). Information about the issuing body of the document (Ex: country or state department).
  • CPF of the legal guardian (for insurance reasons).
  • Complete Medical Record with the history of all participants – the model will be made available by Chão Nosso.
  • Complete Travel Authorization Form for all participants – the model will be made available by Chão Nosso.
  • For air travel: the student must present themselves for boarding at airports strictly at the time previously scheduled with the school coordination;
  • At the time of boarding, in any travel schedule, the student(s) must carry: the personal identification document (identity card), the passport in case of international travel (it is important to ensure that it is not expired, aware that the lack of any of the documents listed above, as well as any damage that makes them illegible, may result in boarding being prevented, resulting in the application of the penalties set out below (cancellation item );
  • In the case of a passenger under 18 (eighteen) years of age, CHÃO NOSSO will provide the necessary guidance for parents and guardians to obtain the necessary authorizations for the trip, whether by land or air, with the parents and guardians being responsible for obtaining the necessary authorizations;
  • Punctual payment of contracted services, with delays resulting in the addition of monetary correction by the IGPM-FGV, interest of 1% per month and a fine of 2% on the outstanding amount;
  • Obtaining visas, authorizations from national and/or foreign authorities or any other document necessary for leaving Brazil or entering the destination country is the sole and exclusive responsibility of the passenger client(s);
  • It is the obligation of the customer(s), during the travel period, to behave in accordance with the rules of good manners and customs, respecting other passengers/tourists, and all customers and passengers are also prohibited from /tourists, under penalty of dismissal, cause disturbance, disorder, offend the physical and moral integrity, health of other tourists, passengers, guides, crew, dirty and/or damage the facilities and equipment of hotels, aircraft, ships and vehicles. The consumption of alcohol by anyone under 18 (eighteen) years of age and the use of any illicit drug, as well as carrying out any other act contrary to current national legislation or the legislation of the country visited, are prohibited.
  • The decision to disconnect the customer(s) for the reasons indicated above will be the exclusive responsibility of the CHÃO NOSSO representative;
  • All luggage, volumes and/or objects carried by the passenger(s) are their responsibility and must be identified with labels and/or invoices proving their acquisition and/or origin;
  • It is the duty and responsibility of the passenger(s) to comply with the regulations in force in each country, regarding the acquisition and transportation of products and goods considered illicit and/or irregular, and it is up to parents or guardians to guide their child-passengers;
  • Provide clear and precise information about the tourist services described in the annex and the documentation required for boarding, in compliance with the rules of the Consumer Protection Code;
  • Provide guidance on the contractual conditions applied and the suppliers of contracted services;
  • Make the requested reservations and issue the necessary documents to use the reserved services;
  • Process any requests for changes or cancellations of services, observing the price conditions for this purpose;
  • In case of operational need, without prejudice to the CONTRACTOR, changes may be made to the schedule, such as additions or exchange of overnight stays, and reversal of the itinerary, at no cost to the CONTRACTED PARTY;
  • The CONTRACTED PARTY does not directly provide any of the tourist services contracted through its intermediation, thus not assuming any responsibility for any and all problems, losses or damages, resulting from acts of God or force majeure, such as, but not limited to, : strikes, natural phenomena, such as floods or even modifications, delays and/or cancellation of routes due to operational and organizational air traffic, technical, mechanical and/or meteorological reasons, over which it has no power of prediction or control, as well thus, due to the contractual breach of service providers.
  • A Chão Nosso Viagens Culturais e Turismo Ltda. declares that it serves as an intermediary between passengers and suppliers (transport companies, hotels, restaurants, boats and other service providers) and cannot be held responsible for errors or errors made by them. We also declare that, if there is any setback resulting from failures related to the suppliers we contract, we will spare no effort to ensure that the trip is carried out within the best quality standards.
  • Prices may undergo changes resulting from exchange rate variations and/or government resolutions that demonstrably change them;
  • Change requests made by the educational establishment and/or passengers will result in the application of penalties, under the contracts signed between the CONTRACTED PARTY and its suppliers, as provided for in the CANCELLATION and RETURNS clause, and will be subject to availability and price updates;
  • For operational, technical or external reasons, resulting from unforeseeable circumstances or force majeure that prevent the total or partial completion of the trip, the CONTRACTED PARTY may make the necessary changes, with the modification of itineraries, schedules, services and periods, and is not obliged to refund the amounts paid
  • CHÃO NOSSO may change, replace or transfer the companies responsible for transport, types of road vehicles, as well as embarkation or disembarkation locations, being exempt from informing the existence of any stopovers or connections that occur during the travel route, if they arise from deliberations of transport companies.
  • If the passenger fails to arrive at the boarding location in a timely manner, the passenger will be penalized for the itinerary, in accordance with the policy of the contracted transport companies, and must bear the costs;
  • A CHÃO NOSSO não se responsabiliza por roubo, furto ou extravio de documentos e objeto de valores durante a viagem, recomendando-se o uso de cofres caso o estabelecimento responsável pela hospedagem possua tal dispositivo, recomendando-se ainda o transporte de bens dinheiro, equipamentos tecnológicos, objetos frágeis e medicamentos com a bagagem de mão, sob vigilância do CONTRATANTE.

Cancellation means giving up on the trip and/or contracted service, as well as changing dates.

After confirming the group trip, the number of passengers will not be reduced to a number lower than that stipulated in item “D – price per passenger”. If there is a reduction in passengers, the price will be readjusted to make the trip viable;

If the trip is canceled (in writing) up to 30 (thirty) days before boarding date, will bear the CONTRACTOR with a fine of 10% on the price of the trip, and the amounts already paid to the airline and all suppliers contracted for the trip will be returned to the CONTRACTOR under the same return conditions as the suppliers (observing the value and reimbursement period in accordance with the returns policy of each contracted establishment);

If the trip is canceled (in writing) between 29 (twenty-nine) and 1 (one) day before boarding date, will bear the CONTRACTOR with a fine of 20% on the price of the trip, and the amounts already paid to the airline, hotels and other suppliers contracted for the trip will be returned to the CONTRACTOR under the same return conditions as suppliers (observing the value and reimbursement period in accordance with the returns policy of each contracted establishment);

In cases of trip cancellation for the entire group with more than 10 (ten) passengers, the rule in the item above will be applied, with the trip rescheduled for another date convenient to the group, educational establishment and CONTRACTED PARTY, REFUND OF VALUES PROHIBITED PAID.

If the CONTRACTING PARTY-passenger withdraws during the trip, no refund will be granted;

In the event of illness or death of the passenger, refunds will also comply with the provisions of the insurance contract.
